The University of Perpetual Help System DALTA (herein referred to as “UPHSD”, “the University”, “we”) respects your privacy rights. It is committed to protecting your personal information and sensitive personal information. This Privacy Notice explains how we collect, process, use, disclose, and safeguard your data under the Data Privacy Act of 2012 (Republic Act No. 10173) and its Implementing Rules and Regulations.

  1. Why We Collect and How We Use Your Information:

UPHSD ensures lawful and authorized processing of personal data, obtaining consent from the data subject when necessary. We collect personal information through forms (web via Google Forms or the forms of the University), calls (via landline or mobile phones), emails, or snail mail, and use your information to efficiently manage the following purposes:

  1. Admission and enrollment processes – administering student recruitment/application, screening of the applications and applicants, advising students on suitable programs/courses, crediting of subjects (for student transferees), and enrollment (assessment for selected courses/programs, paying of tuition fees, ID processing and undergoing medical-dental checkups).
  2. Academic records – maintaining records or academic progress of the students (transcripts, awards, achievements, grades, degrees earned, honors, and disciplinary actions).
  3. Student support services – offering and evaluating students’ grades for Dean’s List honors or scholarship grants; providing academic and mental health counseling (assisting students with academic challenges as well as offering individual counseling for students dealing with personal, emotional, or psychological crises); providing assistance to students with disabilities to ensure equal academic rights; and offering basic medical care, wellness programs, and health education for students.
  4. Tracer study – registration and tracking of the UPHSD Alumni (data gathering about the post-graduation experiences, employment status, career paths, or further education pursuits of the alumni); assessment of the program effectiveness (strengths and weaknesses of the curriculum, teaching methodologies, career services, and support services).
  5. Reports and Statistics – these pertain to the critical aspect of the university administration, ensuring regulatory compliance, accreditation standards, internal audit and planning, financial stability, transparency, and accountability.

 

  1. Storage and Security of Your Information

UPHSD ensures that all collected personal data are properly stored in secured facilities to avoid any unauthorized access. We implement suitable physical, technical, and organizational measures to safeguard your data from unauthorized access, disclosure, alteration, or destruction. We ensure that only authorized personnel have access to your data, strictly for designated purposes

 

Personal data stored via cloud-based platforms is overseen by the Local ITS and Central IT in partnership with the third-party providers, adhering to relevant laws, regulations, and stringent information security protocols.

 

  1. Sharing, Disclosure, and Transfer of Your Information

UPHSD may share, disclose, and transfer your personal information under the Data Privacy Act of 2012 to various offices within the University for the following purposes:

  1. Administering the different services and facilities provided/offered by the UPHSD, including access to computing facilities, turnstiles, portal accounts, library access, and LMS accounts (monitoring of attendance and academic activities/progress).
  2. Ensuring the safety of data subjects within the campus premises through the use of CCTVs. This measure may help deter any occurrences; thus, the policy and procedure of CCTV must adhere to the existing laws and regulations to avoid evidence of breaches.
  3. Displaying Dean’s List honors, awarding of scholarship grants, showcasing achievement for promotional purposes (passing of board/licensure/certification exams), using photos, videos, and other information to promote the University.
  4. Ensuring UPHSD ‘s compliance with statutory and regulatory mandates.

 

We will only share, disclose, and/or transfer personal data with third parties if:

  1. Consent has been freely obtained from the data subject.
  2. It adheres to the Data Privacy Act of 2012.
  3. It is mandated under the statutory or legal obligations.

 

UPHSD’s third parties are:

  • Commission on Higher Education (CHED) and other government bodies such as TESDA, DepEd, LIS/EBEIS, CHED-MARINA, PRC, BID, PEAC, Bureau of Fire, and LGU-LPC.
  • PHMC, QS Star, ISO, PACUCOA, CAAP, and other private companies
  • Canvas and Microsoft 365
  • Sponsors (financial sponsors), scholarships, or loan arrangements
  • Turnitin® for the University’s plagiarism detection source
  • Parent’s Portal for viewing and checking grades and other pertinent information of the student wherein consent or authority is freely obtained from the student
  • Education institutions and placement providers
  • Graduation Organizers

 

  1. Retention and Disposal of Your Information

UPHSD will retain your personal information for as long as necessary to fulfill the purpose as stipulated in this Privacy Notice or as required by law. Subsequently, physical documents are securely disposed of through shredding, and electronic files are removed from the system using a tool provided by the technical expert team.

 

  1. Your Rights

The UPHSD allows the exercise of the following rights of the data subjects:

  1. Right to be informed: You may be notified and furnished with information through the Privacy Notice of the UPHSD and other advisories or announcements regarding what personal data the University collects, uses/processes, stores, shares, maintains, retains, and disposes of.
  2. Right to access: You may request access to the personal data we hold about you.
  3. Right to object: You may object to the processing of your data for particular purposes. Requests can be submitted via email to dpo@perpetualdalta.edu.ph. UPHSD reserves the right to decline any unreasonable requests and may retain certain information necessary for the provision of the University’s services, for legal obligations or compliance purposes.
  4. Right to rectify: You may request to correct any inaccuracies in your data.
  5. Right to erasure or blocking: You may request the deletion/blocking of your data under certain circumstances.
  6. Right to complaint: You have the authority to complain if you feel your personal information has been misused, maliciously disclosed, or improperly disposed, of or that any of your rights have been violated.
  7. Right to damages: You may be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your data, as well as for any violation of your rights and freedoms, upon the judgment of the law.
  8. Right to data portability: You may request to receive a copy of your data in a structured, commonly used, and machine-readable format, but it will undergo a process for approval.

If the rights of the data subjects are to be exercised through a representative, the following must be adhered to:

  • Ensure proper authorization is provided.
  • Justify the representation.
  • Seek approval from the concerned department.

 

  1. Data Subject’s Responsibilities

As the UPHSD’s data subjects, you must be responsible for the following:

  1. Check the accuracy of records – update your details if there are changes or corrections to be made. If there are discrepancies in the academic records, immediately notify the relevant department.
  2. Maintain the privacy of your access – refrain from sharing your accounts with others to prevent any unauthorized incidents related to your account.
  3. Follow the University’s Policy and Procedures and adhere to the Data Privacy Act of 2012.

We reserve the right to update or modify this Privacy Notice at anytime. We will notify you of any material changes by posting the revised Privacy Notice on our website or through other appropriate communication channels.
